‘Svastrino’ a website is managed by Svastrino Consultancy Services and is into the business providing education and career counsellings.

Svastrino helps the students and candidates to understand their potential future education and career options.

The current visitor or the member of this website can be a student, a candidate, a parent or a guardian to the student being any gender as described under the Indian Constitution, understands that you are willing to accept our services to find solutions to your concerns regarding education.

Hereon throughout this agreement, Svastrino, the managing company ‘Svastrino Consultancy Services’ or employees of the firm will be termed as the 'PROVIDER' and any student, candidates, parents or guardians of the students, or any person desiring to accept our services, as a site visitor, a member or a paid customer of the services the provider is offering, will be termed as ‘RECEIVER’ throughout the agreement.

These Terms set forth the terms and conditions under which any Receiver may use our website. By accessing or using the website of our service, you approve that you have read, understood, accept and agree to be bound by these Terms till the time the Receiver uses the site and services offered by the ‘Provider’.

In order to use our website and/or receive our services, the Receiver must be at least [18] years of age, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. Receivers are not allowed to use this website and/or receive services if you are a minor and are booking our services all alone. The Receiver can book our services through the family member whose age is above 18 and can avail services on the major’s name.

 

WEBSITE: (FLOW PROCESS)

The Receiver of the website can explore any page that is allowed by the Provider. The website is made for the sole purpose that the Receivers can understand the various services that are provided by the Provider and then book any of the preferred services by making an advance payment and accommodating the preferred slot from the calendar to receive those services. Once the services are served the Receiver can book another slot by following the same process of bookings.

There are other pages on the website that display information and also allow Receiver (members) to discuss their thoughts and comments. The details of those pages and the way Receivers are welcomed to use those pages is mentioned below:

 

MEMBERS PAGE:

Member’s page is for those Receivers who want to book the services and get a session with the Provider. A Receiver cannot book the services without being a member. In the Members personal page the Receiver can find information on their individual profile, their bookings, their interactions on the forum and people who are following them and people whom they are following. This is a page where social interaction will be maintained by one Receiver with the others but all the receivers will have to make sure that they follow these guidelines mentioned under:

To be a member of this page the Receiver has to register himself on this page with his email ID and Indian mobile number provided which the Receiver shall be allowed to become a member of this website and receive the services for being a member.

The receiver agrees to understand and accept that he shall use all the features of the member’s page to get information on various courses that are provided by the Provider. The receiver also agrees to understand and accepts that he shall not copy, store any information given on the website as a process of counterfeit. The receiver agrees to accept and understand that any such activity of counterfeiting can lead to obligations and may attract legal process for the receiver.

The Receiver also understands that this website is strictly for discussing topics related to Education in India so the receiver shall discuss and share his comments on positive development of the page. Any social, religious, political or any matters that will drive the discussion in other instances will not be accepted and such accounts that are promoting those topics on the website shall be blocked from any further use of the website.

 

FORUM:

The receiver agrees to understand and accept that he is allowed to participate and provide his comments/opinion/ topics and statements on the forum where topics related to education are discussed by other receivers and team members of the providers. The receiver agree to understand and accept that he shall only post legally allowed comments/opinion/ topics and statements on the forum that should not be felt offended to any individual, person, religion or group of people. If any such activity is being promoted by the specific receiver then his membership shall be cancelled and be blocked, all his posts shall be deleted from the forum and his identity shall be revealed if any legal authority demands for the same. The receiver also agrees to understand and accept that the comments/opinion/ topics and statements posted by him on the forum shall not be raciest and he shall not use any foul, aggressive or insulting language on any posts or comments. The receiver agrees to understand and accept that he will take utmost care of the other receivers and providers on the forum. If the receiver is found disobeying or not following any terms on this contract then the providers has the total right to take necessary legal actions against that specific receiver.

 

BOOKINGS:

The receiver agrees to understand and accept that as this is an education and career counseling firm. The Receiver can book the services provided by the Provider for receiving the same through online medium only. The receiver will understand all the terms, conditions, privacy policy, cancellation and refund policy before booking any service through the website of the provider. The receiver will make the payment for booking the session only after understanding and agreeing to all the terms, conditions, privacy policy, cancellation and refund policy without any alteration or modifications thereon. As mentioned in the booking page the service is time bound and once the stipulated time is exhausted the session will stand discontinue irrespective if the receiver has some pending queries unresolved or unanswered. Extensions of any such service will only be possible once the receiver makes the advance payment for the additional hour of service to be received. Also if the provider is preoccupied with his other commitments that are not mentioned on the calendar, the provider reserves the right to continue the session immediately or on some other day and slot that is available thereon. The receiver agrees to understand and accept that the services provided by the provider are just guidance and approaches. Any decision about the future, the education or the career thereon will be taken only by the receiver. The provider or any of their staff will not be forced or legally binded to give any decision thereon. By making the payment for the bookings of the services the receiver also agrees to understand and accept that they have read all the cancellation and refund policy mentioned on every service booking.

The receiver agrees to understand and accept that each booking are specific and a seperate booking has to be done for every student or the receiver. If there are two receivers/ students then two separate slots/ appointments / bookings have to be booked for both the students / receivers. A single booking shall not bepermitted for two different receivers. If the receiver is found manupulating the receiver count, the provider shall decide if he has to continue the session or not. And if there is discontinuation proceeded from the providers front in this rare occasion then the similar cancellation charges shall apply.

 

CANCELLATION POLICY:

To cancel or reschedule any of your appointments the Receiver has to call us at least 30 hours before the session. We levy processing fees of 15% + taxes on all cancellations paid on the 1st counseling amount.  Any cancellation of appointments that happen in the 30 hour limit that is mentioned above shall attract a 25% processing fees + taxes. The amount shall be deducted and the balance shall be refunded within a period of maximum 8 working days from the day of intimation of the cancellation.

 

RESCHEDULING:

We allow 2 rescheduling in total for a client, within a maximum period of 2 months from the date of the first booking. We levy rescheduling fees of 15% + applicable taxes on each single rescheduling of the appointments. If the Receiver is rescheduling his appointments for 2 times, the charges for the rescheduling the appointment two times is 30% + applicable taxes of the actual counseling fees received. The student has to deposit the total balance processing fees in order to get a rescheduled appointment confirmed with us in the direct account of the Provider which will be provided on the call.

 

TRANSFER POLICY:

We do not allow any transfer of service from one receiver to another. The service booked by the receiver shall stay valid as per the terms mentioned in the ‘Validity of cancelled service’ below.

 

REFUND POLICY:

Refunds for simple cancellations (without rescheduling) will be processed within 8 working days after the cancellations have been initiated. The Receiver (student or their parents) shall get the amount after deducting the processing fees mentioned for the direct cancellations.

Refunds for cancellations after single or double rescheduling will be processed within 15 working days after the cancellations have been initiated. The Receiver (student or their parents) shall get the amount after deducting the processing fees mentioned for the direct cancellations. As this refund is being initiated after single or double rescheduling and finally a cancellation the refunds shall only happen on the actual counseling amount that is paid by the receiver and not the rescheduling amount paid by the Receiver (Counseling + Rescheduling). The Rescheduling amount shall be exempted from refunds and the refund will only happen as per the cancellation terms mentioned above.

 

VALIDITY OF CANCELLED SERVICE:

If the session is being cancelled and is pending for rescheduling from the receivers end the service shall stay valid for a period of maximum 90 days from the day of cancellation. If the receiver is not receiving the service within the stipulated period the balance money shall be transferred after deducting any pending rescheduling and cancellation charges mentioned above.

 

LIMITATIONS OF THE PROVIDER:

As the provider is just a service provider who is delivering various services through member, forum and counseling sessions, we as the provider are not responsible if the receiver doesn’t study well, doesn’t perform well, doesn’t fair well in his future or career. The receiver agrees to understand and accept that it will be his total responsibility and he shall not hold the provider responsible for any of such instances. All the decisions and actions taken after the receiver has visited the website of the provider or received guidance from the provider in his life or career after receiving information from this website or having the session shall be the sole responsibility of the receiver only. The state of any guidance provided by the provider can be different or unmatched but the receiver agrees to understand and accept that he will verify all those information and statistics personally before taking a final decision for his education, career & life. The Receiver will never blame/ mention/ hold the Provider responsible for the outcomes he faces after he has taken steps for his Education, Career and life.

 

RIGHT TO SUSPEND OR CANCEL USER ACCOUNT

The Provider may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. The Receiver may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which the receiver has already made payment for.

 INDEMNIFICATION:

The Receiver agree to indemnify and hold [Svastrino Consultancy Services] the Provider harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to inappropriate education and/or career choice or in connection with your use of the website or any of the services offered on the website.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, in no event shall [Svastrino Consultancy Services] the Provider, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, [Svastrino Consultancy Services] the Provider assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

RIGHT TO CHANGE AND MODIFY TERMS

The Provider reserves the right to modify these terms from time to time at their sole discretion. Therefore, The Receiver should review this page periodically. When the Terms are changed in a material manner, we will notify the active Receiver that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

PROMOTIONAL EMAIL & CONTENT:

The Receiver agrees to receive from time to time promotional messages and materials from us (The Provider), by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time. 

PRIVACY POLICY:

The Provider receives, collect and stores any information The Receiver enters on our website or provides us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer/ device to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, mobile numbers, communications); payment details (including credit/ debit card information), comments, feedback, product reviews, recommendations, and personal profile. The Provider also collects information about the receiver’s current academic and life backgrounds before and during the session. Collecting this set of information helps the Provider to understand the background well and further helps in guiding related education and career options precisely.

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated below:

  1. To provide and operate the Services;

  2. To provide our Users  (The Receivers) with ongoing customer assistance and technical support;

  3. To be able to contact our Visitors and Users (The Receivers) with general or personalized service-related notices and promotional messages;

  4. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

  5. To comply with any applicable laws and regulations.

 

Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our services to the Receiver. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 


The payment gateways offered by Wix.com and PAYU service used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

 

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our company, or as otherwise necessary to contact you to enforce our User Agreement, applicable national laws, and any agreement we may have with you. LEGAL JURISDICTION:

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of [India, Maharashtra], without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and the Receiver hereby consents to them being decided exclusively by a court of competent jurisdiction located in Mumbai, Maharashtra, India Only.
